Revealing the underlying contractual relationship

Our client had entered into a trading contract, but began receiving invoices from two sources with the same invoicing details and demanding payment.

How we solved it:

LSR used its knowledge of Chinese corporate registration to swiftly identify that there were two companies of almost the same name, one being incorporated relatively recently. Further discreet enquiries revealed that the two partners in the original company had fallen out and could not agree on who should depart or how to split the assets.

Ultimately one partner left, set up a new company and took the view that clients of the original company were still his, and worthy of invoicing for past work done. Clients were able to identify the valid invoice and settle with the correct party.
